OrderMyDNA Terms of Service

These Terms of Service ("Terms") govern the purchase and use of laboratory and DNA testing services facilitated by OrderMyDNA ("Company," "we," "us," or "our"). This site and these Terms are operated by Leg Up Recovery Franchising. By purchasing, accessing, or using any laboratory testing services, you ("Client," "you," or "your") agree to be bound by these Terms.

Corporate Structure

OrderMyDNA (ordermydna.com) is part of Leg Up Recovery Franchising. This website is operated by Leg Up Recovery Franchising. We do not own the laboratories; laboratory and DNA testing services are currently fulfilled by Dynamic DNA Laboratories. When you access this site through a partner subdomain or referral, the company or brand through which you are purchasing (the partner shown on your subdomain) is an affiliate of OrderMyDNA.

Dynamic DNA Laboratories' name and branding may be present on testing kits, packaging, or other materials you receive. Packaging and kit appearance may differ from images shown on this website.

1. Nature of Services

OrderMyDNA facilitates access to third-party, independent, and certified laboratories that provide genetic and laboratory testing services.

OrderMyDNA does not collect, process, store, analyze, or retain biological samples. All specimen handling and testing are performed by independent partner laboratories.

OrderMyDNA's role is limited to coordinating services, providing access to test reports, and supporting client communication.

The DNA tests offered are the parent DNA test. We present and separate them by purpose (e.g., nutrition, fitness, skin, or other categories) for clarity and marketing. Each product name or category refers to the same underlying laboratory test, organized by use case for your convenience.

2. Eligibility

By using these services, you represent that:

  • You are at least 18 years of age
  • You have legal capacity to enter into this agreement
  • All information you provide is accurate and complete

2.1 Shipping Restrictions

We do not ship to New York, Pennsylvania, Rhode Island, or Maryland.

3. Partner & Referral Model

Laboratory tests are offered through authorized OrderMyDNA business partners. Clients may only purchase tests through participating partners.

By purchasing through a partner, you acknowledge that:

  • The partner facilitated your purchase
  • Your test results may be shared with that partner
  • The partner may provide related services based on your results
  • You authorize such disclosure as part of the service.

4. Ordering & Payment

All laboratory testing purchases are final.

Payment must be completed in full prior to kit shipment. Prices, fees, and shipping costs are subject to change.

You agree to provide accurate billing information and authorize all charges.

5. No Refunds & No Returns

Due to the personalized and sterilized nature of laboratory kits:

  • All sales are final
  • No refunds are provided
  • No returns are accepted
  • Shipping fees are non-refundable

Refunds will not be issued for:

  • Unused kits
  • Unsubmitted samples
  • Expired kits
  • Dissatisfaction with results
  • Client-initiated cancellations

6. Sample Submission Responsibility

You are responsible for:

  • Properly collecting your sample
  • Following provided instructions
  • Submitting your sample promptly
  • Ensuring accurate registration

Failure to submit a valid sample may result in loss of service without refund.

7. Laboratory Processing

All testing is conducted by independent laboratories.

OrderMyDNA is not responsible for:

  • Sample integrity
  • Testing methods
  • Laboratory errors
  • Processing timelines
  • Regulatory compliance of laboratories

Any claims related to testing must be directed to the processing laboratory.

8. Test Results & Limitations

Laboratory results:

  • Are informational only
  • Do not constitute medical advice
  • Do not diagnose or treat conditions
  • Are based on current scientific knowledge

Results may be subject to interpretation and limitations.

You agree not to rely solely on test results for medical or health decisions.

9. No Guarantee of Outcomes

OrderMyDNA does not guarantee:

  • Specific results
  • Accuracy beyond laboratory standards
  • Fitness for a particular purpose
  • Health, performance, or lifestyle outcomes

Genetic and laboratory data reflect probabilities, not certainties.

10. Data & Privacy

Your use of laboratory services is governed by our Privacy Policy.

OrderMyDNA may access and store test reports and related records in accordance with applicable laws.

We do not sell genetic data.

11. Intellectual Property

All reports, materials, branding, and content provided through our platform are owned by OrderMyDNA or its licensors.

You may not reproduce, distribute, or commercialize materials without authorization.

12. Prohibited Use

You agree not to:

  • Misuse testing services
  • Submit fraudulent samples
  • Impersonate another person
  • Resell kits without authorization
  • Violate applicable laws

Violations may result in termination without refund.

13. Disclaimer of Warranties

Services are provided "as is" and "as available."

To the fullest extent permitted by law, OrderMyDNA disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.

14. Limitation of Liability

To the maximum extent permitted by law, OrderMyDNA shall not be liable for:

  • Indirect or consequential damages
  • Loss of data
  • Emotional distress
  • Health-related outcomes
  • Laboratory errors
  • Third-party conduct

Our total liability shall not exceed the amount paid for the applicable test.

15. Indemnification

You agree to indemnify and hold harmless OrderMyDNA, its affiliates, officers, employees, and partners from any claims arising from:

  • Your misuse of services
  • Violation of these Terms
  • False information
  • Unauthorized use

16. Termination

We may suspend or terminate access to services at our discretion for violations of these Terms.

Termination does not entitle you to refunds.

17. Dispute Resolution

All disputes shall be resolved through binding arbitration in Georgia, unless prohibited by law.

You waive the right to participate in class actions.

18. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

19. Changes to Terms

We may update these Terms at any time. Continued use constitutes acceptance of updated Terms.
